JUDICIAL NOTICE OF MEDICAL PROVIDER NETWORK (MPN)– A recent Marina Del Rey case held that the defendant does not need to prove the validity of the certification of their MPN, the court can take judicial notice of the Director’s web site showing that the MPN is certified. In issuing this decision the defendant needs to merely focus on making sure notices at time of hire or implementation and at time of injury were provided to the injured worker in order for them to maintain medical. The decision is in line with others on the MPN and it appears that the main concern of the court is whether or not the injured worker is being prejudice by the MPN, either in delay of treatment or insufficient treatment.
